Bytecheck is owned and operated by Bytemine.
1. The agreement
These Terms & Conditions govern access to Bytecheck’s website, beta program, email validation and email finder services, workspace interface, and APIs (the Service). Bytecheck is operated by SPS Consulting LLC, doing business as Bytemine. ‘Bytemine,’ ‘we,’ and ‘us’ refer to that operator; ‘you’ refers to the person or organization using the Service.
By accessing or using the Service, you agree to these terms. If you use it for an organization, you must have authority to bind that organization. You must be legally able to enter this agreement. If you do not agree, do not use the Service. A separately signed agreement controls where it expressly conflicts with these terms. Mandatory rights under applicable law remain unaffected.
2. Validation, finder results, and beta access
Bytecheck provides email-address checks, bulk processing, email finding, and related API tools. Results are assessments based on information available at the time of processing, not a guarantee that an address belongs to a particular person, will accept a message, or will remain deliverable. A ‘valid’ or ‘found’ result is not evidence of consent or permission to contact someone. Unknown and risky results require your judgment.
Beta, preview, experimental, or simulated results may be incomplete, inaccurate, unavailable, or change without notice. Do not rely on preview results for production decisions. Joining the waitlist does not guarantee access or a launch date. No service-level commitment applies unless agreed separately in writing.
3. Accounts, teams, and API keys
Provide accurate account and billing information. Protect passwords, API keys, and other credentials; notify us promptly of suspected misuse. You are responsible for authorized users and activity within your workspaces, subject to applicable law. Only grant access to people who are entitled to see the data in that workspace.
Credits, records, jobs, and API-key permissions are workspace-specific. Workspace administrators manage access, billing, and keys. Do not share credentials publicly, bypass plan limits, or interfere with another workspace. We may revoke compromised keys or restrict access to protect the Service.
4. Lawful data and acceptable use
You must have a lawful basis and all required rights to submit email addresses, names, domains, and other data. You are responsible for providing required notices, respecting objections and opt-outs, and complying with applicable privacy, electronic-marketing, and anti-spam rules, including GDPR, applicable US state privacy laws, CAN-SPAM, and local equivalents where relevant.
Do not use Bytecheck for spam, harassment, phishing, fraud, credential attacks, unlawful surveillance, or discriminatory decisions. Do not submit unlawfully obtained lists, sensitive personal information unrelated to the Service, or data you are prohibited from processing. Do not probe, disrupt, overload, reverse-engineer protected parts of the Service contrary to law, bypass security or rate limits, or resell access without our written permission. Email finding does not authorize unsolicited messaging.
5. Credits, payments, and auto top-up
Prices, credit quantities, eligibility for free credits, and usage limits are shown in the Service at the time of purchase or use. Email validation ordinarily uses one credit per check; email finder uses five credits per found email, with unsuccessful finder reservations refunded. Check the displayed terms before submitting a job. Credits are not money, cannot be redeemed for cash, and do not move between workspaces unless we expressly support it.
Credit-pack purchases are one-off purchases unless you explicitly authorize another billing arrangement. If you enable auto top-up, you authorize automatic charges to your saved payment method for your selected pack when the configured threshold is reached. Auto top-up can charge more than once in a month as usage consumes credits; it is not a monthly spending cap. You can disable future auto top-ups in billing settings. Disabling it does not reverse completed charges.
Stripe processes card payments. You are responsible for applicable taxes and valid payment details. Contact us about duplicate charges, billing errors, or refund requests; refunds and cancellation rights are assessed under applicable law and any terms disclosed at purchase. Nothing here excludes a mandatory refund or consumer right. Price changes apply prospectively, not retroactively to completed purchases.
6. Your data and our processing role
You retain your rights in submitted data and your own content. You authorize Bytemine and service providers acting on its behalf to process that data as needed to provide, secure, maintain, and support the Service, including validating addresses, producing results, storing workspace history, and handling integrations you configure.
For personal data you submit on behalf of your organization, you generally determine the purpose and legal basis and act as controller; Bytemine processes it on your behalf to deliver the Service. Account, billing, security, and business-contact data are handled for our own operational purposes as described in the Privacy Policy. Where a data-processing agreement or other contractual safeguards are required, arrange them with Bytemine before submitting the relevant data. These terms alone are not a substitute for a required data-processing agreement.
7. Integrations and third parties
You control the recipients and endpoints you connect, including webhook destinations. Ensure they are authorized and secure. Information delivered to your integrations is subject to your arrangements with those services. We are not responsible for third-party services outside our control, and their availability may affect connected workflows.
8. Ownership and permitted access
Bytemine and its licensors retain rights in Bytecheck’s software, branding, documentation, and other Service materials. Subject to these terms, you may access the Service and use its outputs for lawful purposes within the rights you hold in the underlying data. No ownership of the Service or permission to use our trademarks is transferred.
9. Suspension and ending use
You may stop using the Service and request account closure through Bytemine’s official contact channels. Disable auto top-up before stopping use if you do not want further automatic purchases. We may suspend or terminate access for unlawful use, material breach, non-payment, or a security risk, with notice where practical and legally permitted.
Termination does not remove obligations arising before termination. Data may be retained where necessary for legal obligations, dispute resolution, fraud prevention, or backup cycles, as explained in the Privacy Policy. Export needed results before ending use where the Service supports export; contact us for assistance with data requests.
10. Disclaimers and responsibility
To the extent permitted by law, the Service is provided ‘as is’ and ‘as available,’ without warranties of uninterrupted availability, error-free results, fitness for a particular purpose, or guaranteed deliverability. You remain responsible for how you interpret results and use them in your own communications and business decisions.
To the extent permitted by law, Bytemine is not liable for indirect or consequential loss, lost profits, or lost opportunities arising from use of the Service. These exclusions do not apply to liabilities that cannot lawfully be excluded, including fraud or any mandatory statutory liability. Any claim remains subject to applicable law; these terms do not impose mandatory arbitration or waive non-waivable consumer rights.
11. Changes, disputes, and contact
We may update these terms and will publish the revised version with an effective date. Material changes will be communicated through the Service or an appropriate account contact where required. Continued use after changes take effect constitutes acceptance to the extent permitted by law; if you disagree, stop using the Service.
For legal notices, billing questions, complaints, or requests, use the contact channels published at www.bytemine.ai and identify Bytecheck in your request. Disputes are subject to applicable law and courts with lawful jurisdiction; no provision removes protections you are entitled to under mandatory local law.
